Lucas County Woman Seeks Damages for Hit and Run Injuries
On August 19, 2019, our client was driving in Lucas County, Ohio when she encountered a flashing yellow light at an intersection. At the same time, a negligent driver traveling perpendicular to our client failed to stop at a blinking red light, striking the front driver’s side of her car.
Following the collision, the negligent motorist fled the scene. Upon later discovery, the defendant’s license plate was uncovered, and the vehicle was found to be owned by the driver’s husband.
Pursuing Three Causes of Action
On behalf of our client, we are pursuing three causes of action against the negligent driver and her husband. The first cause of action is negligence and breached duty of care. The defendant owed a duty of care to our client to operate her vehicle in a safe manner and abide by state laws, but she failed to do so.
As a direct result of the hit and run accident, our client sustained serious injuries to her neck, shoulders, hips, right leg, feet, and head. Additionally, she has suffered losses such as physical pain, severe mental anguish, and emotional distress. Due to these injuries, our client has had to undergo extensive medical treatment. Her condition is also believed to be permanent, meaning our client will suffer future economic losses due to continued medical care.
In addition to compensatory damages, we are seeking punitive damages against the defendant. By leaving the scene of the accident, the defendant demonstrated a complete disregard for the rights and safety of our client. We assert that this act constitutes malice and warrants a punitive damages award.
We are also seeking damages against the defendant’s husband for negligent entrustment of his car. As the owner, the defendant’s husband had a responsibility to entrust his vehicle to a competent driver. He breached this duty of care by allowing a reckless driver to operate his car. Through these causes of action, we are seeking damages to compensate our client for all her current and future losses.
